Overview
InviteBird, operated by SKYPOP DESIGNS ("InviteBird," "we," "us"), respects the intellectual property of others and asks our users to do the same. InviteBird follows the "Safe Harbor" provisions of the Digital Millennium Copyright Act, 17 U.S.C. § 512 ("DMCA"), and maintains a policy of terminating, in appropriate circumstances, the accounts of users determined to be repeat infringers.
Copyright policy
You may not upload, post, transmit, distribute, or otherwise reproduce on or through InviteBird any material that infringes the copyright of any party. We respond expeditiously to claims of copyright infringement that are reported to our designated copyright agent in accordance with the requirements set out below.
Reporting infringement — DMCA notice
If you believe that material on InviteBird infringes a copyright you own or control, please send a written notice of infringement to our designated copyright agent. To allow us to act on your notice, please include all of the following:
- Identification of the copyrighted work claimed to have been infringed (or, for multiple works on a single site, a representative list of those works).
- Identification of the material claimed to be infringing or to be the subject of infringing activity, with information reasonably sufficient for us to locate it — URLs, screenshots, or the specific event or template page in question.
- Your full name, mailing address, telephone number, and a working email address at which we can reach you.
- A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate, and, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner.
- Your physical or electronic signature.
Incomplete notices may delay or prevent action. When we act on a notice, we may forward it — including your name and contact information — to the user who posted the material, so they can respond or submit a counter-notice. Knowingly making a material misrepresentation that material is infringing may result in liability under 17 U.S.C. § 512(f).
Counter-notice
If you believe that material you posted to InviteBird was removed or disabled by mistake or misidentification, you may submit a counter-notice to our designated copyright agent. Counter-notices must include:
- Your name, address, telephone number, and email address.
- Identification of the material that has been removed or disabled and the location at which it appeared before it was removed.
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of a mistake or misidentification.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or, if outside the United States, for any judicial district in which InviteBird may be found, and that you will accept service of process from the person who provided the original notice or an agent of that person.
- Your physical or electronic signature.
If we receive a valid counter-notice, we will forward it to the person who sent the original notice. Unless that person informs us within ten business days that they have filed a court action seeking to restrain the activity, we may restore the material in ten to fourteen business days, as the DMCA provides. Knowingly making a material misrepresentation in a counter-notice may also result in liability under 17 U.S.C. § 512(f).
Repeat infringers
InviteBird will, in appropriate circumstances and at our discretion, terminate the accounts of users who are determined to be repeat infringers.
