Acceptance
These Terms of Service ("Terms") govern your use of InviteBird, a digital invitation and event-management platform operated by SKYPOP DESIGNS ("InviteBird," "we," "us") at www.invitebird.com. By creating an account, purchasing a plan, or otherwise accessing or using InviteBird, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.
The service
InviteBird lets hosts design digital event invitations, manage guest lists, collect RSVPs, and communicate with guests through email and SMS. You can create an account and design an event for free; sending invitations and certain studios and add-ons require a one-time event plan or a subscription, as described at /pricing. Features vary by plan, and we may add, change, or retire features as the service evolves.
Your account
- You must be 13 or older to use InviteBird.
- You are responsible for safeguarding your credentials and for activity under your account.
- Provide accurate information. Do not impersonate another person or business.
- If you invite co-hosts to an event, they act within your event, and you are responsible for the changes they make and the messages they send there.
Host responsibilities
When you add a guest to an event — including their email address or phone number — you represent that:
- You have a personal or professional relationship with the guest and they have given you their contact information for event communication.
- The guest has given you their contact information for event communication. Guest SMS consent is collected separately by InviteBird through a Reply YES text — not through these Terms. See our SMS opt-in flow and SMS Terms.
- You will not use InviteBird to send spam, marketing blasts to strangers, or any content that violates applicable law.
You remain the originator of the messages sent through your events and are responsible for their content. As the host, you decide who to invite and what guest data to collect; with respect to your guest list you act as the data controller and InviteBird processes that data on your behalf, as described in our Data Processing Addendum. If a third party brings a claim against us because content you uploaded, guests you added, or messages you directed us to send violated these Terms or the law, you agree to reimburse SKYPOP DESIGNS for the losses, penalties, and reasonable legal costs that result.
SMS messaging
SMS opt-in is a separate, standalone consent collected directly from the recipient via a Reply YES confirmation. These Terms of Service do not constitute SMS opt-in. See /sms-opt-in for the full flow.
Guests who receive SMS through InviteBird can opt out at any time by replying STOP. Replying HELP returns our support contact. Typical frequency is 1-5 messages per event. Carrier message and data rates may apply. Carriers are not liable for delayed or undelivered messages. We do not send marketing SMS. Full details appear in our SMS Terms.
Acceptable use
- No illegal, fraudulent, or harmful content.
- No harassment, hate speech, sexually explicit content involving minors, or content that infringes another person’s rights.
- No attempts to break, scrape, reverse-engineer, or overload the service.
- No use of InviteBird to send messages to recipients who have not given consent.
We may suspend or terminate accounts that violate these rules.
Your content and guest uploads
You retain ownership of the content you upload — event details, photos, voice notes, and messages. You grant InviteBird a limited, worldwide, royalty-free license to host, store, reproduce, adapt for technical purposes (for example, resizing photos and generating thumbnails), and display that content solely to operate the service and show it within your event. This license ends when you delete the content or your account, except for the short-lived backup copies described in our Privacy Policy.
When you upload or share content — including on an event gallery, which guests can do without an account — you confirm that you own it or have permission to share it, and that you have the consent of any person who appears in it or whose personal information it contains. Do not upload content you do not have the right to share.
Hosts may moderate, approve, hide, or remove content shared to their events. We may also remove content that violates these Terms. If you believe content on InviteBird infringes your copyright or is otherwise abusive, please report it through our copyright and abuse report form (see our Copyright Policy). We terminate the accounts of repeat infringers in appropriate circumstances.
AI-generated content
Some InviteBird features use artificial intelligence to generate or edit designs, images, songs, speeches, and text based on the inputs you provide. To the extent we hold any rights in that output, we grant you a perpetual, worldwide license to use it for your event and for your own personal or organizational purposes. You are responsible for the inputs you provide, which must not infringe anyone else’s rights or violate the acceptable-use rules above.
AI-generated output may be similar to output produced for other users, and we make no promise that it is unique. Because purely AI-generated material may not be eligible for copyright protection, we do not promise that you will own or be able to register a copyright in it. AI output can also be wrong — inaccurate, incomplete, or unsuitable despite looking polished. You are responsible for reviewing AI-generated content before you send or publish it, and for making sure it is accurate and appropriate for your event.
Billing and subscriptions
Paid plans are billed through Stripe. Subscription plans renew automatically at the then-current price at the end of each billing period until you cancel. You can cancel at any time from your account settings; your plan will not renew again and your access continues through the end of the period you have already paid for.
If we change subscription prices, we will give you advance notice before the change takes effect so you can decide whether to continue. Fees are non-refundable except where required by law; canceling stops future renewals rather than refunding the current period. You can manage or cancel your plan at any time in your account settings.
Refunds on one-time purchases. One-time event purchases — event plans, plan upgrades, the photo pack, album hosting renewals, the keepsake bundle, and similar add-ons — take effect immediately: paying for a plan sends your invitations, and an upgrade raises your guest limit on the spot. Because the service is delivered at purchase, these fees are non-refundable once delivered, except where required by law. If a technical problem on our side kept a purchase from working — for example, your payment succeeded but your invitations did not send — contact us within 14 days and we will make it right, including a full refund where appropriate. Approved refunds go back to the original payment method.
Gift cards
When you buy an InviteBird gift card, the purchased balance never expires. When you redeem a gift card, any remaining balance carries over and stays available for your next purchase. Gift cards are redeemable toward InviteBird event purchases and are not exchangeable for cash except where required by law. A completely unredeemed gift card may be refunded to the purchaser within 14 days of purchase on request. Once any of a gift card’s balance has been redeemed, it is non-refundable. Gift cards are denominated in a single currency and can be applied only to purchases priced in that same currency — we do not convert balances between currencies. We may cancel gift cards that were obtained fraudulently.
Cash gifts and funds
Some events let guests send the host a cash gift or contribute to a fund. These payments are processed by Stripe and go directly to the host’s connected Stripe account. InviteBird adds a 5% platform fee on top of the gift amount; the guest pays this fee, and the host receives the full gift amount. InviteBird is not a party to the gift — we do not hold gift funds in escrow and do not guarantee any gift, which is solely between the guest and the host. Stripe’s terms apply to the payment processing, and hosts are responsible for any taxes that may apply to gifts they receive.
Referral program
You can invite friends to InviteBird with a referral link or code. A referred friend receives 10% off their first event purchase. The discount can be redeemed once per new customer and applies only to a first event purchase. Self-referrals, duplicate accounts, and other abuse void the discount. We may change or end the referral program at any time.
Termination
You can close your account at any time from Profile → Danger zone, or by emailing support. Self-serve deletion starts a seven-day grace period during which you can sign back in and cancel it; after the grace period ends, deletion is permanent. We may suspend or terminate accounts for breach of these Terms or for prolonged inactivity. On termination, event content is deleted per our Privacy Policy. Provisions that by their nature should continue — including outstanding payment obligations, the disclaimer, the limitation of liability, and your reimbursement obligations — survive termination.
Disclaimer
InviteBird is provided "as is" and "as available," without warranties of any kind, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the service will be uninterrupted, secure, or error-free, that every message will be delivered, or that AI-generated content will be accurate or fit for your purpose.
Limitation of liability
To the maximum extent permitted by law, InviteBird and SKYPOP DESIGNS shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, however the claim is framed and even if we were advised the loss was possible. Our total liability arising out of these Terms is limited to the greater of the amount you paid us in the 12 months prior to the claim and US $100. Some jurisdictions do not allow certain of these limits, so parts of this section may not apply to you; in that case, our liability is limited to the smallest amount the law allows.
Changes to these Terms
We may update these Terms. Material changes will be posted here with an updated date, and for significant changes we will make reasonable efforts to give you additional notice, such as an email or an in-app message. Continued use of InviteBird after a change takes effect means you accept the revised Terms; if you do not agree, stop using the service and close your account.
Governing law
These Terms are governed by the laws of the State of Ohio, United States, without regard to conflict-of-laws principles.
